Smith was located at Derrycrow Road at 12.15pm.
He was in the front passenger seat of the vehicle and was arrested.
Mr Hugo Marley, representing the defendant, said Smith had given him written instructions from prison and his client hoped to be out just before Christmas.
He added that Smith had been working as a mechanic and the loss of his licence would hamper him in trying to get employment.
