Insurance cover confusion as two end up in court over van loan

But that was not the case and both of them were fined and given points last Wednesday at Craigavon Magistrates Court.

Martin Corey (64), O’Neill’s Terrace, Lurgan, admitted driving without insurance on May 23 this year while Joseph Martin McIlduff (52), pleaded guilty permitting him to drive without insurance.

Both were fined £300, ordered to pay a £15 offender’s levy, and given six points.

The court heard Corey was stopped while driving a van on the Lough Road, Lurgan. The vehicle belonged to McIlduff who was not present.

At a later date Corey called at Lurgan police station with his insurance certificate and one belonging to McIlduff but neither policy covered him to drive the vehicle.

A solicitor representing both defendants said they had their own insurance and both believed they were insured.

She added that further inquires revealed that a small van was not covered by the insurance.

District Judge, Mr Mervyn Bates, said it was difficult to distinguish between the two parties and this was largely a misunderstanding.
